Landlord
Registration is not optional – it is a requirement
of the Antisocial Behaviour (Scotland) Act 2004. Its intention
is to be able to take action against landlords who do not
take reasonable steps to manage any antisocial behaviour caused
by their tenants. In order to do this, local authorities need
to know who all the landlords are and how to contact them.
However, as you are using 24-7 Letting as your agent, we will
be contacted in the first instance should any antisocial behaviour
be reported. We will be able to advise you of this, and assist
in resolving any issues that may arise.
These measures will take effect in May 2006, so landlords
must be registered, or in the process of registering, by 30th
April 2006. There are a few exclusions to the requirement
to register but in general all landlords must register. We
can advise who must, or who need not, register.
As the main function of registration is to know how to contact
the landlord of any property in Scotland, the main information
required is contact information – names and addresses
etc. However the local authorities are also taking this opportunity
to monitor the suitability of a person to be a landlord so
will ask relevant questions here too. Completing the form
is just an initial step in the process, and registration is
not automatic, though refusal of registration would not be
automatic either. The local authority must judge each landlord’s
suitability before completing the registration process.
As mentioned above,
registration is not optional,
and refusal to register could result in the local authority
seeking a criminal prosecution against an unregistered landlord.
When completed, registration will last for three years after
which time the landlord will have to renew his registration.
Our latest information is that landlords can register online
from 10th March. We will give the website address when it
has been verified and activated. We were advised that West
Lothian Council would have full details on their requirements
by the same date, and we are still awaiting this information.
The fee structure will be as follows:-
There will be a registration fee for the landlord of £55.00.
However, if the landlord registers online a discount of 10%
will apply.
If the landlord has properties in more than one Local Authority
area, the registration fee will apply for each area. However,
if the landlord applies online to register in more than one
area there will a 75% discount for all subsequent areas.
The landlord will have to pay a fee of 20% of the initial
registration fee, or £11.00 per property that is registered.
A landlord with one property can expect to pay:-
Landlord Registration fee £55.00-10% = £49.50
Property Registration fee £55.00-75% = £11.00
Total cost of registration = £60.50
A landlord with five properties can expect to pay:-
Landlord Registration fee £55.00-10% = £49.50
Property Registration fee £11.00 x 5 = £55.00
Total cost of registration = £104.50
A landlord with one property in each of two different
areas can expect to pay:-
First area Landlord Registration fee £55.00-10% = £49.50
Second area Landlord Registration fee £55.00-75% = £13.75
Property Registration fee £11.00 x 2 = £22.00
Total cost of registration = £85.25
Please note these figures are for illustration only. We
are still waiting for WLC to verify that they will apply the
charges and structure in this way.
