Housing (Scotland) Act 2006
As part of the Housing (Scotland) Act 2006, provisions
came into effect on 3rd September 2007, which extend the statutory
obligations of a private landlord to repair a house or flat.
From that date, most houses or flats in private rented sector
must meet the new Repairing Standard.
On the same date the former Rent Assesment Panel became the
new Private Rented Housing Panel. This orginasation will become
the means through which a private tenant can enforce the Repairing
Standard.
The Repairing Standard will apply to all new tenancies as
well as existing ones. Under the standard, a private landlord
will have to ensure that:
- the property is wind and water tight.the structure and
exterior of the property are in reasonable repair and proper
working order
- the installations in the property for the supply of water,
gas and electricity and for sanitation, space heating and
heating water are in reasonable repair and proper working
order.
- any fixtures, fittings and appliances provided under the
tenancy are in reasonable repair and proper working order.
- any furnsihsings provided under the tenancy are capable
of being used safely for the purpose for which they are
designed.
- there is satisfactory provision of smoke alarms.
